1. Description of Service

SkyThex Tech operates a cloud-based social media management platform enabling users to schedule and manage content across major platforms including Facebook, Instagram, TikTok, LinkedIn, X, YouTube, and Pinterest, plus AI tools and analytics.

2. Eligibility

Users must be at least 16 years old. Those accessing the service for business purposes represent they have authority to bind their organization. The service is not available in jurisdictions where prohibited.

3. Account Registration

Accurate information is required during signup. Users bear responsibility for credential security and account activity. Unauthorized access must be reported to support@skythex.com immediately. Account sharing and multi-account creation to bypass plan limits are prohibited.

4. Subscription Plans and Billing

Available plans include 3-Day Trial ($5.99), Weekly Access ($10.99), Weekly Pass ($14.99), 15-Day Pass ($17.99), Monthly options ($19.99), and Yearly options ($99.99). Billing occurs in advance via Stripe. Recurring charges continue until cancellation. Taxes are the user's responsibility.

5. Cancellation Policy

Customers may cancel anytime through account settings or support. Cancellation takes effect at billing cycle end. No partial-period refunds apply unless required by law.

6. Refund Policy

Generally non-refundable, except: technical failures unresolved within 72 hours allow refunds within 7 days; duplicate charges are reimbursed; yearly plans may receive prorated refunds within 14 days if minimally used. Refund requests go to support@skythex.com with transaction details.

7. Acceptable Use

Prohibited activities include: violating laws, posting spam, distributing malware, harassment, publishing illegal content including CSAM, unauthorized access attempts, and infrastructure disruption. Violations result in suspension or termination.

8. Connected Social Accounts

Users comply with third-party platform terms independently. SkyThex Tech manages content only as directed. Platform penalties are not SkyThex Tech's responsibility. OAuth tokens are stored securely and revocable.

9. Intellectual Property

Users retain ownership of their content while granting SkyThex Tech a limited, non-exclusive, royalty-free license for operations. The SkyThex Tech platform itself remains company property and cannot be copied or modified without permission.

10. Privacy

The Privacy Policy governs data handling and is incorporated by reference.

11. Availability and Modifications

High availability is targeted but not guaranteed. Features and services may be modified or discontinued with reasonable notice. Term updates with material changes require 14 days' notice before enforcement.

12. Disclaimer of Warranties

The service is provided "as is" without warranties of merchantability, fitness, or non-infringement.

13. Limitation of Liability

Indirect damages including lost profits and data are not recoverable. Liability caps at amounts paid within 12 months preceding claims.

14. Indemnification

Users defend SkyThex Tech against claims arising from service use, user content, term violations, or third-party rights infringement.

15. Termination

Users may terminate anytime (effective end of cycle). SkyThex Tech may immediately terminate for violations or legal requirements. Data deletion follows privacy policy procedures.

16. Governing Law and Dispute Resolution

Texas law governs. Disputes resolve through binding arbitration in Austin under American Arbitration Association rules. Injunctive relief available for IP infringement.
